ANNOTATING THE DECLARATION OF INDEPENDENCE. I just came across this essay on the Declaration of Independence by Professor Randy Barnett in a link from Instapundit. The essay begins by noting that: “The Declaration constituted high treason against the Crown and every person who signed it would be executed as traitors should they be caught by the British.” (I posted here about SIGNING THEIR LIVES AWAY by Denise Kiernan and Joseph D’Agnese, which describes the risks and losses for each of the signers). Professor Barnett’s essay then explains the text of the Declaration as a legal document, equivalent to a formal indictment of the Crown and Parliament.
